NOTICE OF ELECTION
TOWN OF SOUTH BETHANY

Saturday, May 29, 2021 9:00 a.m. – 3:00 p.m.

There will be an Election at Town Hall with Covid-19 safety guidelines.
Absentee Voting on the basis of Covid-19 is also permitted.

There are three (3) seats open for council members for a two (2) year term.

Resident/Non-resident Members
Town Councilmembers (3 vacancies). The Town Charter provides that at
least four of the seven members of the Town Council (which includes the
Mayor) must be residents of the town, but all may be residents of the Town.
Based upon the current composition of the Town Council, and the Mayor’s
residency requirement, one (1) of the three (3) Councilmember seats
up for election must be a Resident and two (2) may be filled by either
a Resident or a Non-resident freeholder. The candidates that are
Residents: Carolyn Bell, Richard Oliver, and William Tim Shaw. The
candidates that are Non-Residents: Edith Dondero and Maureen
Webster.
VOTER ELIGIBILITY
Pursuant to §C-6A (1) of the Town Charter
(1) Any natural person shall be qualified to vote in any annual municipal
election, special election, or referendum who, on voting day, shall:
(a) Have attained eighteen (18) years of age
(b) Be a citizen of the United States
(c) Be registered under the town's voter registration ordinance
(if one is in effect); and
(d) Have been one of the following:
[1] A freeholder in the town, as defined herein, for a period of ninety (90)
consecutive days immediately preceding the date of the election.
A "freeholder" shall be deemed to include any natural person who holds
title of record either in his/her own name or as trustee to a fee simple
estate or a life estate in and to real property located within the
corporate limits of the town.
[2] The spouse of a freeholder whether their name is on the deed or not.
[3] A resident of the town. A "resident" shall mean any natural person who
has been physically residing within the corporate limits of the town for
at least thirty (30) days prior to the election *, and who is physically
residing within the town on the date of the election.
[4] Provided, however, anything herein to the contrary notwithstanding, not
more than eight (8) persons per property shall be entitled to vote either
as a “freeholder” or as the spouse of a “freeholder” under subsection
A(1)(d)[1] and [2] immediately preceding.
*NOTE: Text is modified pursuant to 15 Del. C. §7554(a), for purposes of
voter eligibility, the residency requirement shall be 30 days immediately
preceding the date of election.

ABSENTEE BALLOT VOTING
You must complete an Affidavit to receive an Absentee Voting Ballot. Three
ways to receive an Affidavit:
1) Stop in Town Hall, 402 Evergreen Rd, South Bethany, DE.
2) Call (302)539-3653 to request an Affidavit be mailed to you.
3) Download an Affidavit from our website; southbethany.delaware.gov
“Info Tab”, “Election Info”. After submitting a completed Affidavit to Town
Hall, you will receive an Absentee Ballot.
An Affidavit must be submitted with the Town no later than 12:00 noon the
day before the election. The Absentee Ballot must be completed and
returned to Town Hall by the closing of the polls at 3:00 p.m. on Election
day.

Deadline for Absentee Ballot to be mailed to an elector: A completed
Affidavit requesting an Absentee Ballot to be mailed to the elector must be
received at Town Hall four days prior to the election; May 25, 2021. It is the
responsibility of the elector to return the completed ballot to Town Hall (by
mail or hand-delivered) by the closing of the polls at 3:00 p.m. on Election day.
