At the Sussex County Sheriff's Office, West Complex, 22215 DuPont Boulevard, Georgetown, Delaware, Georgetown Hundred, Sussex County, State of Delaware, the following described real estate to wit:

ALL THAT CERTAIN LOT, piece and parcel of land situate, lying and being in the Town of Frankford, Dagsboro Hundred, Sussex County, Delaware, and lying on the Southwestern right-of-way of Clayton Avenue, being more particularly described as follows, to wit:

BEGINNING at an iron pipe (FD), said iron pipe located on the Southwestern right-of-way of Clayton A venue, said iron pipe also being located at the corner of these lands and lands now or formerly of M.E. Church Parsonage South 78 degrees 47 minutes 14 seconds West 174.56 feet to a concrete marker (FD); thence turning and running South 15 degrees 43 minutes 04 seconds East 14.82 feet to a concrete marker (FD); thence turning and running South 74 degrees 47 minutes 02 seconds West 42.84 feet to a concrete marker (FD); thence turning and running by and along the Northeastern right-of-way of the lands now or formerly of Penn Central Railroad North 16 degrees 12 minutes 10 seconds West 107.01 feet to a concrete marker (FD); thence turning and running by and along the common boundary line between these lands and lands now or formerly of Patrick J, Quigley North 81 degrees 00 minutes 00 seconds East 228.77 feet to an iron pipe (FD); thence turning and running by and along the Southwestern right-of-way of Clayton Avenue South 08 degrees 57 minutes 12 seconds East 80.06 feet home to the place of beginning and said to contain 19,528 square feet of land be the same more or less, together with any and all improvements thereon, as surveyed by Simpler Surveying, Registered Land Surveyors, on December 6, 2001.

Being the same lands and premises which Karen L. Sanders, Katherine Elliott, John C. Elliott, Paul X. Elliott, Jeffrey W. Elliott, Kimberly L. Vitale (f/k/a Kimberly L. Elliott), and Keith K. Elliott, heirs of the Estate of Dorothy L. Elliott, did grant and convey unto Karen L. Sanders and Terry L. Sanders, Sr., by deed dated October 13, 2005 and recorded on October 18, 2005 in the Office of the Recorder of Deeds, in and for Sussex County, State of Delaware, in Deed Book 3218 at Page 152.

Registration is required for all bidders prior to sale. A $4,000.00 deposit (Cash or Cashiers/certified check payable to Sheriff of Sussex County) and valid driver’s license or photo I.D. are required to register.

TERMS: 20 percent of the purchase money will be demanded on day of sale (The $4,000.00 Bidder Registration Fee will be credited to the 20% deposit). Cash, Certified Check or Cashier's Check, is required. The balance is to be paid on or before November 21, 2011. Sale subject to confirmation by the Superior Court on November 28, 2011 and also subject to a 1 1/2 percent Delaware Realty Transfer Tax; 3/4 percent to be paid by the Seller and 3/4 percent to be paid by the Purchaser. Also subject to 1 1/2 percent Sussex County Realty Tax, 3/4 percent to be paid by the Seller and 3/4 percent to be paid by the Purchaser. Any further Transfer Tax is the responsibility of the Purchaser.
