PUBLIC NOTICE

NOTICE IS HEREBY GIVEN that on April 19, 2012, the Ocean View Board of Adjustment took the following action on pending applications:

• Application V-250, a request for a variance from Article V,
§ 999-28 and § 999-32 of the Land Use and Development Chapter
of the Town Code, submitted by William and Mary Jane Goodwin.
The applicants seek a variance that will permit an attached
accessory structure (garage) to encroach 2.4 feet into the required
side lot line setback on property located at 6 Assawoman Avenue
(014.120) (1-34-12.00-1719.00).
APPROVED

• Application V-252, a request for a variance from Article V,
§ 999-28 and § 999-32 of the Land Use and Development Chapter
of the Town Code, submitted by Richard Parry. This variance
seeks to permit existing side lot line encroachments for two
attached accessory structures (shed and O/S) 10+/- feet, two
detached accessory structures (shed) 7.7+ feet, and (pool house)
1.1+/- and .9+/- feet respectively to continue. It also requests a
front lot encroachment of 3.5+/- feet (proposed covered entry) and
a side lot line encroachment of 7+/- feet (attached carport with
second floor dwelling area) on a property located at 49 Central
Avenue (234.000) (1-34-12.00-614.00).
APPROVED WITH CONDITION

• Application V-253, a request for a special exception, submitted by
Robert Thornton, so that independent and assisted living facilities
as well as Alzheimer’s memory care facilities be permitted to be
inclusive at property zoned MXPC – Mixed Use Planned
Community located on Beaver Dam Road (413.000)
(1-34-16.00-various).

• Application V-251, a request for a variance from Article V,
§ 999-32 of the Land Use and Development Chapter of the Town
Code, submitted by Wanda Powell. This variance seeks to permit
two existing detached attached structures (sheds) to continue to
encroach into the side and rear lot line setbacks and allow for
construction of a detached accessory structure that will have a
maximum height of 18+/- feet above grade on property located at
7, 9, and 13 Oakland Avenue (193.000, 194.000, and 195.000)
(1-34-12.00-545.00).
