BOARD OF ADJUSTMENT PUBLIC NOTICE

NOTICE IS HEREBY GIVEN that on July 19, 2012, the Ocean View Board of Adjustment took the following actions on pending applications:

• Application V-254, a request for a variance from Article V, § 140-32 of the Land Use and Development Chapter of the Town Code, submitted by Garrett & Liz Gauldin. This variance seeks to permit an existing outside shower to encroach 1 +/- feet into the required 30 foot rear yard setback on a property located at 164 Willow Oak Avenue (PIDN: 331.192 / Sussex CTM#: 134-16.00-1848.00).
APPROVED

• Application V-255, a request for a variance from Article V, § 140-32 and § 140-28 and Article VI, § 140-35-A(2)(b) and B(2)(c) of the Land Use and Development Chapter of the Town Code, submitted by James Fagan. This variance seeks to permit an existing deck that exceeds 24” in height from grade to encroach 13.7 +/- feet into the required 30 foot rear lot line setback, to allow the construction of a paver patio with a grill and counter top area in excess of 36” high that if approved will encroach 23.7 +/- feet into the required 30 foot rear lot line setback and will increase lot coverage to 47 +/-% on a property located at 39 Willow Oak Avenue (PIDN: 326.200 / Sussex CTM#: 134-16.00-1232.00).
Variance to permit an existing deck that exceeds 24” in height from grade to encroach 13.7 +/- feet into the required 30 foot rear lot line setback

Variances to erect the barbeque area that is approximately 4’1” above grade and an 18” high sitting wall with 24” pillars affixed to the proposed paver patio and increase lot coverage in excess of 45%
DENIED

• Application V-256, a request for a variance from Article V, § 140-28 and § 140-32 and Article XVI, § 140-100-D(12)(b)[2] of the Land Use and Development Chapter of the Town Code and Article III, §187-10-A of the Streets and Sidewalks Chapter of the Town Code submitted by the Ocean View Historical Society. This variance seeks to permit an existing structure to encroach 16.6 +/- feet into the required front lot line setback and 8.9 +/- feet into the required side lot line setback, to allow a proposed detached accessory structure to encroach 9 +/- feet into the required 10 foot rear lot setback and 14.1 +/- feet into the required side lot line setback and allow detached accessory structures in excess of 14 feet in height on a property located at 39 Central Avenue (PIDN: 239.000 / Sussex CTM#: 134-12.00-609.00).
