NOTICE IS HEREBY GIVEN that on November 13, 2012, the Ocean View Board of Adjustment took the following action on pending applications:

• Application V-259, which is a request for a variance from Article V, § 140-28 and § 140-33 of the Land Use and Development Chapter of the Town Code submitted by the property owners, Henry & Linda Alt. Article V, § 140-28 requires a side lot line setback of 15 feet for principal structures and attached accessory structures and § 140-33 permits a chimney to encroach 24 inches into the side lot line setback in the R-1 zone wherein this parcel is located. This variance seeks to permit an existing principal structure with attached accessory structure and a chimney to encroach a maximum of .4 feet into the required side lot line setback on property located at 2 Bridle Lane (PIDN: 001.190 / Sussex CTM#: 134-12.00-831.00).

• Application V-260, which is a request for a variance from Article V, § 140-32 of the Land Use and Development Chapter of the Town Code submitted by the property owner, Tanya Sue Gourley. Article V, § 140-32 limits the maximum height of a detached accessory structure to 14 feet. This variance seeks to permit the applicant to erect a detached accessory structure (garage) with a height exceeding 14 feet on properties located at 1 and 3 Kent Avenue (PIDN’s: 321.140 and 321.150 / Sussex CTM#’s: 134-12.00-515.00 and 134-12.00-516.00).

• Application V-261, which is a request for a variance from Article V, § 140-28 and § 140-32 of the Land Use and Development Chapter of the Town Code submitted by the property owners Robert & Kathleen Wooster. Article V, § 140-28 requires a rear lot line setback of 30 feet for principal structures and attached accessory structures and § 140-32 requires a 10 foot rear lot line setback and 15 foot side lot line setback for detached accessory structures. This variance seeks to permit an existing principal structure with attached accessory structure (screen porch 14’x14’) to encroach 9.1 +/-feet, an attached accessory structure (outside shower 3.9’x8’) to encroach 3.9 +/-feet into the required rear lot line setback, and a detached accessory structure to encroach 5 +/- feet into the required rear lot line setback on property located at 25 N. Horseshoe Dr. (PIDN: 004.170 / Sussex CTM#: 134-12.00-665.00).
