NOTICE IS HEREBY GIVEN BY the Board of Adjustment of the Town of Ocean View that a public hearing will be held on Application V-271, which is a request for a variance from Article V, § 140-32 of the Land Use and Development Chapter of the Town Code submitted by Kelly Fox, on behalf of the property owners Gary & Dorothea Biddinger. Article V, § 140-32 requires a side lot line setback of 15 feet for accessory structures that are either attached to or detached from the principal structure and a 5 foot separation between structures in the R-1 zone where this parcel is located.
This variance seeks to permit an existing accessory structure to encroach into the required side lot line setback and also seeks to add a principal structure that will be constructed within the required 5 foot setback from any other structure on property located at 16 N. Horseshoe Dr. (PIDN: 004.080 / Sussex CTM#: 134-12.00-720.00)
The hearing will be held at the Town Hall located at 32 West Avenue at 6 p.m. or as soon as possible thereafter on Thursday, May 16, 2013.
The appropriate material may be examined by interested parties on the second floor of the Wallace A. Melson Municipal Building located at 201 Central Avenue between 8:30 a.m. and noon and 1 through 4 p.m., Monday through Friday.
All interested parties are welcome to attend and present their views. If unable to attend the public hearing, written comments will be accepted but must be received prior to the hearing.
